This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you interact with our website www.thelivingoutlet.com and any related products or services. It also outlines your rights and choices regarding your personal information. This Policy is intended for general business use and may include optional sections for specific industries or regions.

By using our website, products, or services, you agree to the practices described in this Privacy Policy. If you do not agree, please discontinue use of our services.

This Privacy Policy is governed by and construed in accordance with the laws of the State of Wyoming, United States.

Types of Data Collected

We collect several types of information from and about users for various purposes as described below. The exact data collected will depend on your interactions with us, but it generally includes:

  • Personal Identifiers: Information you provide to us, such as your name, contact details (email address, telephone number, postal address), account username/password, and other identifiers.

  • Customer Records & Account Information: Payment information (billing address, last four digits of credit card or other payment details) and account profile details. If you create an account or make a purchase, we collect information needed to process transactions and maintain your account.

  • Usage Data: Information collected automatically about your use of our services. This may include your IP address, browser type, device identifiers, pages or screens viewed, referring URLs, clicks and interactions, and timestamps of visits. We may also log device and network information such as operating system, as well as diagnostic data about how our services are performing.

  • Cookies and Tracking Technologies: We use cookies, web beacons, and similar tracking technologies to collect usage data and enhance your experience (see Cookies and Tracking section below for details). For example, we might use cookies to remember your login, understand how you navigate our site, and tailor content or advertisements to you.

  • Communications: The content of your communications with us, such as emails, customer support inquiries, or chat messages. If you contact us or respond to our communications, we will collect and retain that information.

Please note: You can choose not to provide certain personal information. However, doing so may limit your ability to use some features of our website. We only collect information that is relevant for the purposes stated in this Policy and as allowed by law. We do not collect sensitive personal information (such as Social Security Numbers or health data).

How Data Is Used

We uses your personal information for the following purposes:

  • To Provide and Maintain Our Services: We process personal information to fulfill our contractual obligations to you, such as creating and managing user accounts, processing orders or transactions, and providing the features or functionality you expect. For example, we use personal details to process orders, complete transactions, and deliver products or services you request. We also use contact information to communicate with you about your account, subscriptions, or customer support inquiries.

  • To Improve and Personalize Your Experience: Personal data is used to understand and analyze user behavior in order to improve our offerings. We may use your information to customize website content, remember your preferences, and develop new features or services. This includes analyzing usage patterns and feedback to enhance functionality, usability, and customer experience.

  • Communication and Notifications: We use contact information (like email or phone number) to send administrative information (e.g. confirmations, technical notices, updates, security alerts) and, where permitted, marketing communications. If you sign up for newsletters or promotional materials, we will send those to you. You can opt out of marketing emails at any time by using the unsubscribe link or contacting us directly.

  • Advertising and Analytics: We may use data about you to provide relevant advertisements and marketing, both on our services and on other platforms. For instance, we might use your browsing history or purchase history to recommend similar products or show targeted ads (with your consent where required). We also use analytics data to understand the effectiveness of our advertising and marketing campaigns.

  • Compliance and Legal Obligations: We process personal information as needed to comply with applicable laws, regulations, and contractual obligations. This includes using data to fulfill tax, accounting, and legal requirements, and to respond to valid legal requests (such as court orders). We may also use your data to enforce our terms of service and to prevent fraud or other prohibited activities.

  • Security and Fraud Prevention: Information (including usage data and device information) is used to maintain the security of our website and services. We monitor for suspicious or malicious activity and may use personal data to prevent, detect, and investigate fraud, cyber incidents, or other abuse of our services.

  • Other Purposes (with Consent): If we intend to use your personal information for a purpose not described above, we will explain it at the point of collection and, if required, obtain your consent. We will not use your data in ways that are incompatible with the purposes for which it was collected without notifying you and obtaining appropriate consent.

We make sure that we have a valid legal basis to use your personal information. Depending on the context, our legal basis may include your consent, the necessity to perform a contract with you, compliance with a legal obligation, or our legitimate business interests (such as improving our services or ensuring security).

Sharing and Disclosure of Information

We do not sell personal information under any circumstances. We do not sell your personal information to third parties for their independent use.  However, we may share your personal data with third parties in certain circumstances, as outlined below, in order to operate our business and provide our services to you:

  • Service Providers: We share personal information with third-party vendors and service providers that perform functions on our behalf. This includes companies that assist with payment processing, shipping and fulfillment, data analysis, email delivery, hosting, customer service, and marketing. For example, if you make a purchase, your payment information is shared with payment processors and your shipping address is shared with carriers or fulfillment partners to complete the transaction. These service providers are contractually required to handle personal data only as necessary to provide their services to us and to maintain the confidentiality and security of your information.

  • Business Partners and Affiliates: In some cases, we may partner with other businesses or become affiliated with companies (e.g., as part of a group of companies). We may share information with our affiliates or carefully selected business partners for joint marketing, promotions, or to offer integrated services – but only if you have engaged with those offerings or if such sharing is otherwise permitted by law. All affiliated entities are required to follow privacy practices no less protective than those described in this Policy.

  • Legal Requirements and Protection: We may disclose personal information when we believe in good faith that such disclosure is necessary to comply with a legal obligation or process. This includes responding to subpoenas, court orders, or lawful requests by government authorities. We may also disclose your information to protect our rights, privacy, safety or property, or that of our customers or others; to enforce our policies or contracts; or to investigate fraud or security issues. In these cases, we will only share the data that is reasonably necessary for the purpose and in accordance with applicable law.

  • Business Transfers: If we undergo a business transaction such as a merger, acquisition, reorganization, or sale of some or all of our assets, personal information may be transferred as part of that deal. For example, in the event of a merger or sale, customer information is typically one of the business assets that may be transferred to the acquiring party. If such a transfer occurs, the use of your personal information by the successor entity will still be governed by this Privacy Policy (unless you are notified of changes and consent to them).

  • With Your Consent: We will share your personal information with other third parties when you direct us to or give us consent to do so. For instance, if you intentionally share information or content through our service (e.g., posting a public comment or sending messages to other users), that information will be visible to the intended recipients or the public as per your settings. Also, if you opt-in to a co-branded service or event, your information may be shared with the relevant third party with your permission.

  • De-Identified or Aggregated Data: We may share information that has been aggregated or anonymized in such a way that it cannot reasonably be used to identify you. For example, we might publish reports on usage trends or share statistics with partners or the public (e.g., “X% of our users are in North America”) — but this data will not include any personal identifiers.

We require all third parties with whom we share personal information to protect it and to use it only for the purposes we specify. Where applicable, we rely on appropriate safeguards (such as data processing agreements or standard contractual clauses) to ensure that your personal information remains protected when transferred to service providers or partners in other jurisdictions.

Data Retention

We will retain your personal information only for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements.

  • In general, this means we keep your data for the duration of your relationship with us and a reasonable period thereafter. For example, if you have an account, we will retain your account information while your account is active and for a certain time after account deletion, in case you decide to reactivate or as needed to comply with legal obligations.

  • Transactional records (such as purchases, payments, and communications with us) are retained as long as required to complete the transaction and for record-keeping as mandated by law (for instance, financial records may be kept for tax and audit purposes).

  • If you request that we delete your personal data (see User Rights below), we will make reasonable efforts to securely erase or anonymize the information. However, we may retain certain limited information to the extent required: for example, to comply with laws, resolve disputes, enforce our agreements, or as necessary for security (such as to detect fraud).

  • Usage Data (e.g., analytics data) is generally retained for shorter periods, unless it is used to strengthen security or improve functionality of our service, or we are legally required to retain it for longer. We may also keep aggregated, non-identifying data for business analysis purposes without time limits, to the extent it contains no personal information.

When personal information is no longer necessary, we will securely destroy or de-identify it. We implement appropriate technical and organizational measures to ensure that data is securely disposed of and rendered unreadable upon disposal.

Cookies and Tracking Technologies

Our website uses cookies and similar tracking technologies to distinguish you from other users and to optimize your experience. Cookies are small text files placed on your computer or device that help us remember your preferences and understand how you use our site. In this section, we explain how we and third parties use these technologies and what choices you have.

Types of Cookies We Use:

  • Essential Cookies: These cookies are necessary for the website to function and cannot be switched off in our systems. For example, they enable core functionality such as user authentication, security, and network management. You can set your browser to block or alert you about these cookies, but some parts of the site may not work without them.

  • Preference Cookies: These cookies allow our site to remember choices you make (such as your username, language, or region) and provide enhanced, more personalized features. They may be set by us or by third-party providers whose services we have added to our pages.

  • Analytics Cookies: We use these cookies to collect information about how visitors use our website, such as which pages are visited most often and if users get error messages from web pages. These cookies help us improve the performance of our website by ensuring visitors easily find what they are looking for.

  • Advertising & Marketing Cookies: These cookies track your browsing habits to enable us and our third-party marketing partners to show you ads or content that are more likely to be relevant to you. They record things like your visits to our site, the pages you have visited, and the links you have followed, as well as your interaction with our advertisements on other platforms. If you have consented to these cookies, they allow us to deliver targeted advertising and measure the effectiveness of ad campaigns. We also use Google Analytics and Google Ads remarketing tools for advertising and measurement purposes. You may opt out of personalized advertising by visiting https://www.aboutads.info/choices

How We Use Cookies:
When you visit our site, we (and certain third parties) may use cookies and similar trackers to automatically collect certain data. We use cookies to personalize content, remember your settings (such as items in your shopping cart or your login status), and analyze site traffic and user behavior. For example, cookies help us keep you logged in during your session and track whether you’ve visited before. They also help us provide features like customer chat support or embedded videos by remembering some of your choices. We and our analytics providers use cookie data to identify which parts of our site are most popular and see how users move through the site, enabling us to improve navigation and interface.

If we use advertising cookies, they will be used in conjunction with our advertising partners to show you relevant ads on our site or elsewhere. For instance, if you browse products on our site, you might later see advertisements for those or similar products on other websites. No personally identifiable information (like your name or email) is shared with advertising partners for these purposes; instead, an identifier like a cookie ID or device ID is used. Our partners may combine this information with other data they have collected about you to tailor ads or measure their campaigns’ performance.

Third-Party Analytics and Tracking:
We use third-party analytics tools (such as Google Analytics, etc.) that set their own cookies to collect information about user interactions. These services help us understand aggregate usage patterns. We have set up these services to anonymize IP addresses where possible and not to share personal data. However, because these are third-party services, their use of your data is subject to their own privacy policies. We also integrate third-party widgets or features (like social media “like” buttons or maps) that may set cookies. We do not control these cookies, and their use is governed by the privacy policy of the third party providing them.

Google Analytics & Google Ads: We use Google Analytics and Google Ads (including remarketing and conversion tracking). Google may use cookies or device identifiers to personalize ads and measure advertising effectiveness. You can opt out of Google’s advertising cookies via https://www.google.com/settings/ads or opt out of device-based tracking through your device settings.

Your Choices for Cookies:
You have several options to control or limit how cookies are used on your devices:

  • Browser Settings: Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies or alert you when a cookie is being placed on your computer. Check your browser’s help section for instructions on how to manage cookies. Please note that if you disable cookies entirely, our site (and many other sites) may not function properly, and you might not be able to sign in or use some features.

  • Cookie Banner & Preferences: On our website’s first visit (and periodically), we may display a cookie consent banner or preferences tool. You can use this to accept or reject non-essential cookies (such as marketing and analytics cookies). You can also manage or disable cookies at any time through your browser settings. Each browser provides different controls, typically found under “Privacy” or “Security” settings.

  • Do Not Track Signals: Some browsers offer a “Do Not Track” (DNT) feature that lets you tell websites not to track you. At this time, our site does not respond to DNT signals due to the lack of an industry standard for compliance. We will update our practices if a uniform standard is adopted.

  • Opt-Out Mechanisms: For third-party advertising cookies, you can also utilize industry opt-out sites for more control. Visit the Network Advertising Initiative’s opt-out page or the Digital Advertising Alliance’s opt-out page at https://www.aboutads.info/choices to opt out of interest-based advertising from participating companies. These tools allow you to opt out of many (but not all) targeted advertising cookies in one step. Keep in mind, if you opt out, you may still see ads, but they will be less personalized. Also, the opt-out relies on cookies; if you clear your cookies, you may need to opt out again.

User Rights and Choices

Depending on your jurisdiction and the applicable privacy laws, you may have certain rights regarding your personal information. We strive to honor all valid requests related to these rights. Below is a general overview of the rights that may be available to you and how you can exercise them:

  • Access Your Information: You have the right to request access to the personal data we hold about you. This allows you to receive a copy of the information and to learn how we process it. Upon verification of your identity, we will provide you with the relevant data, unless an exception applies.

  • Correct Your Information: If any of your personal information is inaccurate or incomplete, you have the right to request correction or update of that data. We will correct any confirmed inaccuracies or, if appropriate, provide supplementary information to make sure your data is accurate.

  • Delete Your Information: You can request that we delete some or all of your personal information (the “right to be forgotten”), subject to certain exceptions. For example, we may retain data if required for legal obligations or legitimate business purposes (such as completing a transaction you initiated, or if retention is mandated by law). When we receive a valid deletion request, we will remove or anonymize the personal data not subject to an exception and confirm with you once completed.

  • Restrict Processing: In certain situations, you have the right to request that we limit the processing of your personal information. This could apply, for instance, if you contest the accuracy of the data or if you want to restrict processing while an objection you raised is resolved.

  • Object to Processing: You have the right to object to our processing of your personal information in some cases. In particular, you can object to any processing conducted on the basis of our legitimate interests or for direct marketing purposes. If you object, we will re-evaluate your request and will stop or limit processing unless we have compelling legitimate grounds to continue or as otherwise permitted by law. If you object to direct marketing, we will cease using your data for that purpose.

  • Data Portability: Where applicable (e.g., under GDPR), you may request to receive your personal information in a structured, commonly used, and machine-readable format, and have the right to transmit that data to another controller (or have us do so, where technically feasible). This right applies to information you provided to us and that we process by automated means on the legal basis of consent or contract.

  • Withdraw Consent: If we rely on your consent to process personal data (for example, for optional marketing), you have the right to withdraw your consent at any time. Withdrawing consent will not affect the lawfulness of processing based on consent before its withdrawal. If you withdraw consent, we may not be able to provide certain features or services to you. We will advise you if this is the case at the time you withdraw consent.

  • Marketing Communications: Even if not covered by a specific law, we allow all users to opt out of receiving promotional emails or newsletters from us. You can do this by clicking the “unsubscribe” link in such emails or contacting us as described below. Please note that you may still receive transactional messages (e.g., emails about your purchases or account) even if you opt out of marketing communications.

  • Other Rights: Depending on your jurisdiction, you may have additional rights such as the right not to be subject to a decision based solely on automated processing (including profiling) that significantly affects you, or the right to non-discrimination (e.g., we will not treat you differently for exercising your privacy rights). We will not deny you goods or services, charge you a different price, or provide a different level of quality of services for exercising any of your rights, except as permitted by law.

Exercising Your Rights: You (or an authorized agent acting on your behalf) can submit requests to exercise applicable rights by contacting us using the information in the Contact Information section of this Policy. Please clearly describe your request – for example, what information you would like to access, or which information you want updated, deleted, or restricted. For your privacy and security, we will take steps to verify your identity (such as requiring you to log into your existing account or provide certain identifying information) before fulfilling your request. Verification steps will vary depending on the sensitivity of the information and the nature of your request.

We will respond to privacy rights requests within the timeframe required by law (for example, within 30 days under some regulations, with the possibility of a reasonable extension if needed). If we need more time or cannot comply with some aspect of your request, we will inform you of the reason (such as a conflicting legal requirement or an exception under the law). If your request is denied in whole or in part, we will also provide an explanation.

Data Security

We take the security of your personal information seriously. We have implemented a combination of administrative, technical, and physical safeguards designed to protect your personal data against unauthorized access, disclosure, or destruction. These measures include, but are not limited to:

  • Encryption: We use encryption protocols (such as SSL/TLS) to secure data in transit. For example, when you enter sensitive information (like login credentials or payment details) on our website, that data is encrypted during transmission.

  • Access Controls: We limit access to personal information to employees, contractors, and agents who need that information to perform their job duties. All such personnel are bound by confidentiality obligations. We also employ authentication measures (like strong passwords and, where appropriate, two-factor authentication) to prevent unauthorized access to user accounts.

  • Network & System Security: Our systems are protected by firewalls and monitoring for intrusion detection and prevention. We regularly update our software and systems to address potential security vulnerabilities. We store personal data on secure servers, and for particularly sensitive information, we may use additional protections such as encryption at rest or partitioning from general systems.

  • Training and Policies: Our team members are trained on data protection best practices and required to follow company policies on information security. We maintain incident response plans and review our security procedures periodically to adapt to new threats.

  • Third-Party Security: When engaging third-party service providers (such as cloud hosting or payment processors) that handle personal information, we ensure they have appropriate security measures in place through contractual commitments. These providers must adhere to industry standards for security (for example, payment processors are required to be PCI-DSS compliant for handling credit card data).

While we strive to protect your information, no method of transmission over the internet or electronic storage is 100% secure. Therefore, we cannot guarantee absolute security. You should also play a role in keeping your data safe. We encourage you to use unique and strong passwords, not share your account credentials, and notify us immediately if you suspect any unauthorized access to your account or any security breach.

In the event of a data breach that affects your personal information, we will notify you and the appropriate authorities as required by law. We will also take all reasonable steps to mitigate the impact and prevent future occurrences.

International Transfers

Because we use service providers in multiple jurisdictions, your personal information may be transferred to, stored, or processed in a country different from your home country. In particular, our primary operations are based in “the United States”, so by using our services, you acknowledge that your data may be transferred to and processed in the United States, which may have data protection rules different from those of your country.

When we transfer personal information across national borders, we take steps to ensure that adequate protections are in place in compliance with applicable data protection laws:

  • Adequacy and Safeguards: If you are located in a region with data transfer restrictions (for example, the European Economic Area), we will ensure that a lawful transfer mechanism is in place. This may include verifying that the destination country has an “adequate” level of data protection as determined by the relevant authority, or implementing standard contractual clauses (SCCs) or other appropriate data transfer agreements to cover the export of personal data.

  • Service Providers Abroad: Many of our external third-party service providers (such as cloud hosting, CRM tools, etc.) are also based in other countries. We contractually require that these providers handle personal information in accordance with this Privacy Policy and applicable law. When necessary (for example, for EU data), we execute data processing agreements with standard safeguard provisions with such providers.

  • Your Choices: If applicable law provides you with certain choices or conditions for cross-border data transfers, we will respect those. For instance, we will seek your consent for transferring your data to a different country if that consent is required. You have the right to be informed about the safeguards we’ve put in place for international transfers; you can contact us for more information on these safeguards (e.g., a copy of the standard contractual clauses).

  • Consent to Transfer: By providing us with your information or using our services, to the extent permitted by law, you consent to the transfer of your personal information across international borders. We understand that not all countries have the same data protection laws. In all cases, we will protect your information as described in this Policy.

Please note that data stored in other countries may be subject to lawful access by courts, law enforcement, or other authorities in those jurisdictions pursuant to local laws. However, our practices will continue to be governed by this Privacy Policy and the security commitments we have made herein.

Children’s Data

Protecting the privacy of children is especially important. Our services are not directed to children under the age of 13, and we do not knowingly collect personal information from anyone under 13 years old without verifiable parental consent. If you are under 13, please do not use our website or service or provide any personal information. In the event we learn that we have inadvertently collected personal data from a child under 13, we will take immediate steps to delete such information from our records.

If you are a parent or guardian and you believe we might have collected information from your child under the age of 13, please contact us promptly so that we can investigate and address the issue. We will remove the data and unsubscribe the minor from any of our services upon verification.

We do not knowingly use children’s personal data for any purpose, including not selling or sharing children’s data for behavioral advertising. Our content is intended for a general audience and not for kids. If we ever engage in activities that involve personal information of children (e.g., a contest or educational program directed at minors), we will do so in accordance with applicable children’s privacy laws like the U.S. Children’s Online Privacy Protection Act (COPPA) and relevant regulations, including obtaining necessary consents from parents or guardians.

Changes to the Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other operational reasons. When we make changes, we will post the most current version of the Policy on our website and update the “Last Updated” date at the top. Any changes will become effective when posted unless indicated otherwise.

If we make material changes that significantly affect how we handle your personal information, we will take additional steps to inform you. This may include providing a notice on our homepage prior to the change becoming effective and/or directly sending you a notification (for example, via the email associated with your account). We encourage you to review this Privacy Policy periodically to stay informed about our data practices and how we are protecting your information.

Your continued use of our services after any update to this Privacy Policy will constitute your acknowledgment of the changes and your agreement to be bound by the revised Policy, to the extent permitted by law. If you do not agree with the changes, you should discontinue use of our services and contact us regarding removal of your personal data as per your rights outlined above.

For your protection, we may only fulfill requests for the personal data associated with the email address or other contact information that you use to send us the request, and we may need to verify your identity before implementing your request.

E-commerce Policy

When you place an order through our website, we collect information necessary to fulfill that order. This includes your contact details, shipping address, billing address, and payment information. We use this data to process your payment and to deliver the products or services you purchased. Specifically, we will share your shipping address and contact phone/email with our delivery partners or suppliers strictly for the purpose of fulfilling your order and delivery. Payment card details are handled securely; we use accredited third-party payment processors to handle credit/debit card transactions. We do not store full credit card numbers or sensitive payment details on our systems – such information is provided directly to our payment processors, which are compliant with the Payment Card Industry Data Security Standard (PCI-DSS). These payment providers are authorized to use your personal information only as needed to process payments or comply with legal requirements.

For more information on our shipping, returns, and payment policies, please refer to the corresponding pages available on our website.

In an e-commerce context, we also maintain order history and purchase records associated with your account (if you have one) or your transaction. We use this information for customer service (e.g., to handle returns or warranties), to suggest relevant products, and to analyze sales trends. Unless you have opted out, we may use your email to send information related to your purchase, such as order confirmations or shipping notifications, and – if permitted – follow-up communications asking for feedback or offering related products.

We may combine commercial information about your purchases with other data (like browsing behavior) to better understand our customers’ preferences. This helps us improve our product offerings, personalize your experience, and provide personalized ads or promotions (with consent, if required). For instance, knowing what products you viewed or bought enables us to highlight similar items you might like in the future.

Additionally, running an e-commerce business means we partner with various third parties to operate efficiently. As noted in the general Privacy Policy, third-party service providers (such as inventory management systems, fraud prevention services, review platforms, etc.) may receive relevant data. For example, we might share your order ID and email with a third-party service that sends out review requests or with a tool that helps us prevent fraudulent transactions by analyzing order information. All such providers are bound by contracts to use your data only for the specific services they provide us, and they must protect it in accordance with this Policy.

We want to be transparent that if you make a purchase from us, your transaction may involve multiple parties – our company, the payment gateway, the shipping carrier, etc. At each step, only the information necessary for that party’s role is shared. We do not allow our service providers to use your data for their own marketing or other purposes not related to your order.

Regional Privacy Addendums

Laws regarding data privacy can vary depending on your location. The following regional addendums provide additional information and rights that apply to you if you are a resident of these jurisdictions. Please refer to the sections that are relevant for your situation. If there is any conflict between this general Privacy Policy and a regional addendum, the addendum for your region will prevail for matters specific to that law.

California Privacy Rights (CCPA/CPRA) (Optional)

If you are a resident of California, you have specific privacy rights regarding your personal information. The following provisions apply to personal information of California residents as defined under Cal. Civ. Code § 1798.100 et seq. (collectively referred to here as “CCPA”). Terms like “sell,” “personal information,” and “share” are used as defined in the CCPA.

Categories of Personal Information Collected: In the preceding 12 months, we have collected the following categories of personal information about California consumers, to the extent they were provided by you or gathered as described in this Policy:

  1. Identifiers: such as real name, alias, postal address, unique personal identifier, online identifier, IP address, email address, account name, or other similar identifiers.

  2. Customer Records: paper/electronic customer records containing personal information, such as telephone number, credit card or debit card number (with security code or password in combination), billing address, and payment information. (Note: We do not collect driver’s license or government ID through the site unless specifically requested for verification in certain cases.)

  3. Commercial Information: such as records of products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

  4. Internet or Other Electronic Network Activity: such as browsing history, search history, information on a consumer’s interaction with our website, or advertisement (this can include analytics and cookie data).

  5. Geolocation Data: such as approximate location derived from IP address or precise geolocation if you’ve allowed a browser to access location.

  6. Inferences: drawn from the above information to create a profile about a consumer’s preferences or behavior (e.g., segments for marketing).

We collect these categories of information from the sources and for the purposes described in the “Types of Data Collected” and “How Data Is Used” sections of this Policy. For instance, identifiers and customer records are collected directly from you when you make a purchase or create an account; internet activity is collected automatically through cookies; geolocation may come from your device or IP; commercial info is generated through your transactions with us; and inferences are derived from analysis of your interactions.

Disclosure of Personal Information: In the past 12 months, we have disclosed the following categories of personal information for one or more business purposes (with service providers or others as detailed in Sharing and Disclosure above): Identifiers, Customer Records, Commercial Information, Internet Activity, Geolocation Data. These disclosures were to service providers or contractors (e.g., payment processors, cloud hosting, analytics providers, etc.), affiliates, or in connection with business transactions as explained previously. Each recipient falls under the definition of a service provider, contractor, or third party under CCPA, and we ensure appropriate agreements are in place. We do not disclose sensitive personal information (as defined by CPRA) except for the necessary business purposes allowed by law (e.g., if we had SSN for employment, we wouldn’t use it outside of that context).

Sale or Sharing of Personal Information:

  • No Sale/Sharing: We do not sell personal information or share it for cross-context behavioral advertising, as defined under the CCPA/CPRA. We have not disclosed personal information to third parties for these purposes in the past 12 months, and we do not permit third-party advertising networks, social platforms, or data brokers to use our data for their own targeted advertising.

We do not have actual knowledge that we sell or share the personal information of consumers under 16 years of age. We also do not use or disclose sensitive personal information (such as precise geolocation or financial information) for purposes other than those necessary to provide our services, as permitted by CPRA §7027.

Your California Privacy Rights: Under CCPA/CPRA, California residents have the following rights with respect to their personal information:

  • Right to Know: You have the right to request that we disclose to you the specific pieces of personal information we have collected about you. You also have the right to know the categories of personal information we have collected, the categories of sources of that information, the business or commercial purpose for collecting (or selling/sharing, if applicable) the information, the categories of third parties with whom we share personal information, and for each category of personal information, the categories of information we have disclosed for a business purpose or sold. Essentially, this allows you to ask us, “What do you know about me and how and why do you use it and with whom do you share it?” and we will provide either the specific info or the categories as required.

  • Right to Delete: You have the right to request that we delete personal information we collected from you and retained, subject to certain exceptions. Once we receive and confirm a verifiable consumer request, we will delete (and direct our service providers/contractors to delete) your personal information from our records, unless an exception applies. Note that we may deny deletion requests if retaining the information is necessary for us or our service providers to complete the transaction you requested, detect security incidents, comply with legal obligations, or other CCPA-recognized exemptions. If an exemption applies, we will inform you in our response.

  • Right to Correct: (Effective January 1, 2023 under CPRA) You have the right to request that we correct inaccurate personal information that we maintain about you. Upon a verifiable request, we will use commercially reasonable efforts to correct the inaccurate information, taking into account the nature of the personal information and the purposes of processing.

  • Right to Opt-Out of Sale or Sharing: If we engage in activity that is considered “sale” or “sharing” of personal information under CCPA, you have the right to opt-out of that. This means you can direct us not to sell or share your personal information with third parties for monetary or other valuable consideration or for cross-context advertising privacy.ca.gov. We have provided a clear and conspicuous “Do Not Sell or Share My Personal Information” link on our website footer for you to exercise this right at any time, or you may use an authorized opt-out signal like the Global Privacy Control (GPC) via your browser if configured – we honor such signals as a valid opt-out request for that browser. Once you opt-out, we will refrain from selling or sharing your information moving forward unless you later provide consent (which CCPA calls “opt-in”) for such activities.

  • Right to Limit Use of Sensitive Personal Information: This right applies if we collect “sensitive personal information” (SPI) as defined by CPRA (like precise geolocation, racial or ethnic origin, etc.) and use it for reasons other than those exceptions allowed by law (such as providing the requested services). We do not currently use sensitive info beyond permissible purposes. If we ever do, California residents would have the right to limit our use and disclosure of SPI to only what is necessary to perform the services or provide the goods you requested, or as otherwise allowed. We would provide a “Limit the Use of My Sensitive Personal Information” link in that case.

  • Right to No Retaliation/Non-Discrimination: You have the right not to receive discriminatory treatment by us for the exercise of your CCPA privacy rights. We will not deny you goods or services, charge you different prices, or provide a different level or quality of service just because you exercised any of your CCPA rights. If we offer any financial incentives tied to your personal information (for example, a loyalty program or coupon exchange for data), we will present terms and request opt-in consent, and you may opt out of such programs at any time.

Submitting CCPA Requests: To exercise your Right to Know, Delete, or Correct, you (or an authorized agent acting on your behalf) can submit a verifiable consumer request to us by either:

Please include “California Privacy Rights Request” in the subject line and let us know which right you wish to exercise. We will need to verify your identity to process these requests. This may involve matching information you provide with information we have on file (for instance, confirming ownership of the email associated with your account by responding to a message, or other identity verification questions). If you have an account with us, we may ask you to submit the request through your account login (since that authenticates your identity). If an authorized agent (like someone with power of attorney or a company you’ve designated) submits a request on your behalf, we will require proof of authorization and still verify your identity directly (unless the agent has an appropriate power of attorney under Cal. Probate Code).

We aim to respond to verifiable requests within 45 days as required by law. If we need more time (up to an additional 45 days, totaling 90 days), we’ll let you know the reason and extension in writing. Our response will either be delivered through your account (secure inbox) or via email/mail depending on what is appropriate. For Right to Know requests, we will provide the information for the 12-month period preceding your request (you can request beyond 12 months as of 2023 if applicable regulations allow it for the specific pieces of info, but currently we limit to 12 months unless a longer period is mandated). For deletion requests, we will either confirm deletion or explain what was deleted and what we couldn’t delete (with the reasons, e.g., legal compliance). For opt-out requests, we will comply by ceasing sale/sharing of your data from that point on.

Financial Incentives: (If you have any loyalty program, referral program, or discount that involves collecting, keeping, or selling personal info, CCPA says you should explain it here, including a good-faith estimate of the value of the data and how the incentive is commensurate with that value. If none, state that you do not offer any financial incentives related to the provision of personal information.)

Currently, we do not offer financial incentives or price differences in exchange for the retention or sale of your personal information. In other words, we don’t have a program where you get a discount or reward for allowing us to sell your data, etc. If that changes, we will update this policy and provide required notices and opt-in consents.
